Bali is the place that dreams are made of, with its friendly people, stunning scenery and great weather. But to buy land in Bali can be a big challenge. When you are ill prepared, the dream can just as easily escalate into a nightmare. When it comes to purchasing land in Bali, when opposed to the rights open to native people of the island, foreigners are at a distinct disadvantage. We have learned a range of important things that you should know before buying a property in Bali, based on our experience.

1. Understand the Ownership Structures in Indonesia

The aim is to understand how to protect your investment by upholding the Indonesian district-level land ownership laws. Amongst most countries Indonesian land ownership laws stand out because for foreigners, Indonesian companies and Indonesian residents, land rights are different. In terms of owning land, Indonesia has strict criteria and a collection of ownership titles for both locals and foreigners, making ownership possible for everyone. When you are aware of these law you can only then proceed to buy land in Bali.

2. Shop around and Inspect the Land

The best way to buy land in Bali is to get a proper understanding of the reality of the land you are purchasing or renting into is to physically visit the land and meet the owner eye to eye.
We often see people buying inexpensive, standard property with no amenities or infrastructure. Before purchasing it is important to have clear understanding of the price and to compare all possible plots you can acquire in the general area. All this to avoid mistakes and second thoughts in the future.

3. Land Security and Pre Due Diligence Checklist

In order to protect yourself when it comes to legal disputes concerning the title and possible land claims or encumbrances, it is very important that any land listing submitted for sale has accurate, full and legitimate property documents, agreements, paid taxes, vendor I.D and a signed listing agreement from the entity representing the property. To prevent issues down the road of buying property in Bali we recommend that you discuss these topics with the seller:

Whether they can present ownership documents.
Whether they can present irreversible road access legal documents.
Whether they have issued IMBs for the plot.
Whether they have documents detailing the exact land parameter.
Whether there are currently any issues with the plot or the house on the property.

Whether they could in case of rental or purchase provide you with the properly signed documents verifying that the landowners have been fully paid and could not present any disputes.

4. Get Advice from a Professional

In the past there have been many cases when foreigners got duped on Indonesian land purchases and never had the chance to at least get their money back.
However, all of these possible issues are absolutely avoidable if you do your due diligence correctly and ask the proper questions right from the start.
Having a great notary is key. A few that we can contact have proven to bring proper results and good service.
